摘要：随着我国经济的发展和生产力的提高，环境污染日益严重，重大环境污染事故罪在之前的司法实践上难以发挥作用，《刑法修正案（八）》出台后，对重大环境污染事故罪做出了较大的改动，但仍有不足。如何使新的污染环境罪能够更好的在司法实践中发挥作用，是目前环境治理的关键之一。
本文第一章是污染环境罪的概述，主要讲述本罪的概念和特点；第二章是污染环境罪的构成要件的重点阐述，主要从本罪的客体、客观方面及主观方面，其中客观方面对犯罪行为、犯罪结果以及犯罪类型分析，主观方面对归责原则重点论述；第三章是污染环境罪的认定，主要讨论本罪罪与非罪的界定，非法处置的认定，因果关系的认定以及与他罪的区别，进而讨论本罪的法定刑；第四章是对本罪的完善建议，主要是细化罪名及增加刑罚种类。
